Terms and Conditions

1. General

A. This website is operated by Afrimood Webshop (referred to as “Afrimood/webshop/we/our/us”). It is important that you read these terms and conditions of use carefully before you register with Afrimood Webshop.
B. The webshop services are provided on the basis of these terms and conditions. Please note that they may vary from time to time without notice to you.
C. When you use the webshop or any Afrimood services you may be advised that special guidelines apply. Unless otherwise stated, these guidelines or rules form part of these terms and conditions.
D. These terms and conditions apply to all users (including casual browsers) whether or not the registration process has been completed.
E. If you are not a consumer, you must confirm that you have authority to bind any business on whose behalf you use this webshop.

2. Services

Afrimood webshop services are available at www.afrimood.com. The services may vary from time to time as Afrimood aims to continuously improve the services based on demand. Therefore services may be added and removed without a separate notice and certain services may have their own, additional special terms and conditions. These will be made clear to you before you use those services. Afrimood will, however, endeavor to let you know of this via the webshop.

3. Price

A. The prices payable for products that you order are as set out on the webshop. Prices on the webshop are valid and accurate. In case of any mistakes or where a product’s correct price is lower than the stated price a refund will be issued for the difference and dispatch the order in the usual way. Where a product’s correct price is higher than the stated price we will inform you of the correct price and give you the opportunity to proceed with the order at the correct price or cancel the order.
B. Many products have free shipment. On other products the delivery charges are added at checkout.

4. Payment

A. Payment can be made by credit card i.e.(Visa, Mastercard), through a Paypal-account and by account transfer directly to Afrimood.

B. VAT 24% is included for products shipped from Finland where Afrimood maintains a small stock. VAT on products shipped from any other destination is payable at the receipt of the product and is managed by the shipping company directly or by the customer.

5. Confirmation of Order

A. Following the completion of your order, Afrimood will send to you an email acknowledging your order. This email is an order confirmation and the acceptance of your order.
B. Your order is accepted and the contract concluded when the product ordered is posted to you unless either you or Afrimood subsequently cancel the order.

6. Your right to cancel the contract

A. You may cancel your contract with Afrimood for the products you order at any time up to the end of the fourteen (14) days from the date you receive the ordered products. Kindly refer to our Return Policy.
B. Once you have notified Afrimood that you are canceling your contract, in the future any sum debited to Afrimood from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the products in question are returned by you and received by Afrimood in the condition they were in when delivered to you. 

7. Cancellation by Afrimood

A. Afrimood reserves the right to cancel the contract with you if it has insufficient stock to deliver the products you have ordered, and more cannot be obtained within a reasonable time.
B. If Afrimood does cancel your contract, you will be notified by e-mail.

8. Postage

A. The products will be posted or shipped to you. 
B. The products can be picked up at your post office once you receive notification of arrival from your post office. The cost of postal delivery is included into the final price unless otherwise advised. For items shipped directly from coutries other than Finland the VAT is payable at the receipt of the product and directly by you. When the products are shipped to you through a shipping company, the product will be shipped directly to you. You will be notified of the shipment after your order confirmation.

When ordering multiple products you may receive the total delivery in more than one packages. This is because some products are shipped by our manufacturers directly.

9. Shipment of goods to you

A. Afrimood will deliver the products ordered by you to the address you give us for delivery at the time you make your order.
B. The products will be posted in 5-30 working days after your order is accepted and confirmation sent to you. The duration of the product delivery may vary depending on the destination. When ordering multiple products you may receive the total delivery in more than one packages. This is because some products are shipped by our manufacturers directly.

* Premium shipment for products in stock (5 working days)

* Normal shipment for products shipped from the manufacturing country (14-21 working days)

* Custom shipment for products that are custom made by your specifications (30 working days)

C. You will become the owner of the products you have ordered when they have been delivered to you. Once the products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
E. Products for delivery outside the European Union may be subject to import duties, taxes and/or customs charges. These charges are levied once the product arrives at its destination, and must be paid by the recipient. You assume full responsibility for complying with any importation regulations. Please contact your local customs office for further details if necessary.

10. Return Policy

A. You can return and change the products purchased from Afrimood within 14 days after receiving the products if the product is unused. Any broken or faulty products will be replaced. This return policy only applies to products that are unused. During the 14 days you have the right to examine and try the products as you would if the purchase would have been made in a shop. You will however lose the right to return the product after you have started using it. Remember to keep all the return documents (order confirmation and possible payment receipts) safe.
B. Faulty or broken products will always be replaced or refunded to you. If you are unsure of the conditions, always email us on info@afrimood.com before returning the product. Afrimood is not responsible to replace or refund products that are faulty or broken due to your necklet. Other than clothing, custom made products cannot be returned or changed.
C. From Finland the return is free if done within the policy terms stated here. From anywhere else you will need to return the product at your own cost EXCEPT when the product is faulty or broken in which case Afrimood will refund you the cost of return. Also note the following conditions when returning a product:

* The product must be returned within 14 days of receipt of the product.

* The product must be returned in the original package and appropriately packed.

* You need to include the copy of the order confirmation and the possible receipt of payment.

* You should describe to us the reason for the return / describe the type of problem.

* Include the following information: your name, address, phone number and account number for possible return of funds.

Note: Make sure Afrimood receives the product undamaged by using the original packaging and when necessary additional cushioning or wrapping. Afrimood does not accept product refund if the product is broken during transportation due to inadequate packing.

11. Registration

A. Certain services are only available if you complete the registration process. By completing the registration process, you are stating that you are at least eighteen years of age or a minor with parental consent to use Afrimood webshop. Please note: All minors are recommended to discuss these terms and conditions with their parents before completing the registration process.
B. In return for you using the webshop and benefiting from the services, you agree to: provide true, accurate, current and complete information about yourself where required in the registration form, and to ensure that this information is kept accurate, complete and up to date. All details are strictly confidential and may be withdrawn at our sole discretion with a written request by you.

12. Code of Conduct

You are not permitted to use the webshop or any of the services for any reason or purpose which is unlawful, defamatory, harmful or objectionable and, in particular, you are not permitted to transmit anything that, in our opinion, harms our business or offends other users. You are not permitted to do anything that may in any way disrupt the operation of our website and services, nor are you permitted to do anything that would disrupt the use and enjoyment of our website and our services by any other user. 


13. Proprietary Rights and Licences

All text, music, sound, photographs, graphics, video, page layouts, design and other material that is contained on Afrimood webshop or is part of the services, is protected by Afrimood’s and its partners’ copyrights, trade marks, service marks, patents or other proprietary rights and laws. Afrimood owns or is licensed to use all intellectual property rights (including all copyrights, patents, trade marks and trade secrets) in connection with and in all versions of the website and the services, the software used to operate the webshop and services and any data (including data obtained from you during the registration process) generated by users of the webshop and services. You are not permitted to change, copy, store, publish, rent, license, sell or distribute in any way any of these intellectual property rights.

14. Advertisements and Promotions

Afrimood may use the webshop services and any of its other services, to run advertisements promoting products and services in the correspondence with you. Afrimood is additionally a retailer of products for some of its partners and the webshop naturally includes information of these products. 

15. External Links

We may provide or third parties may provide links to other websites or resources. These are provided purely as a matter of convenience and we do not endorse the contracts of those websites. We are not responsible for the availability of these websites,  nor will we be liable in any way for any loss or damage which you my suffer by using those websites. If you decide to access linked third party websites you do so at your own risk.

16. Indemnity

You agree to indemnify us and hold us harmless from and against any claims, actions or demands (including any legal fees incurred in connection therewith) resulting from your misuses of our website or your breach of these terms and conditions. We will notify you promptly of any such claim, action or demand and will assist you as may be necessary providing you meet our costs and expenses (including our legal fees).

17. Limitation of Liability

A. To the extent that Afrimood is lawfully able to do so, it will not be liable for any claims, losses and/or damages of any nature resulting from: a) your miss use and use of the webshop against the instructions) statements or conduct of any third parties. 
B. If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, you must notify Afrimood within 3 working days of the delivery of the goods in question.
C. If you do not receive goods ordered by you within 14 days of the date on which your order was confirmed (excluding products with extended delivery which is stated prior purchase), you must notify Afrimood in writing at our contact email address info@afrimood.com of the problem within 20 days of the date on which you received your order confirmation. If you notify a problem to us under this condition, our only obligation will be at your option to clarify reasons for the detail where possible and to make good any shortage or non-delivery; or to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the products in question in whatever way Afrimood may choose.

Note: With the products that will be manufactured only after your order has been confirmed, the final delivery time will vary but is in each case clearly stated when you make the order. In these cases the delivery time can be longer than 14 days.

18. Events beyond our control

We shall have no liability to you for any failure to deliver any goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstances beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire explosion or accident.

20. Privacy

You acknowledge and agree to be bound by the terms of our privacy policy. The information collected at the point of registration will be used to maintain customer relations and to enable client contacts as required by Afrimood services. The registry will include information on the customer’s name, email, street address and phone number. The information will be kept during the whole duration of customer relationship and the information is protected as required by Law. Afrimood can use the information in its own marketing and advertising. Customer can forbid any use of his/her information for such purposes. Afrimood will not give any customer information to third parties and you can check at any time your personal information stated in our registry and ask wrong information to be corrected. Any such requests should be sent by email to info@afrimood.com.

21. Entire agreement

These terms and conditions, together with Afrimood current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the products to you by us. Nothing said by any sales person on behalf of Afrimood, should be understood as a variation of these terms and condition’s or as an authorized representation about the nature or quality of any goods offered for sale by Afrimood.
